General conditions of sale
1. PURPOSE
These General Terms and Conditions of Sale apply to products sold on the website www.yade-paris.fr, operated and published online by Yade. All orders placed on the Website are subject to these General Terms and Conditions of Sale. These are subject to change and update; the terms and conditions applicable to a Customer's order of a product are those in effect on the day the order is placed.
All of this information is in French. The Customer declares that they have full legal capacity to enter into these general terms and conditions. Thus, any order placed with Yade implies the Customer's unreserved acceptance of these terms and conditions.
2. AVAILABILITY AND ENFORCEABILITY
Consumers can view the general terms and conditions directly on the seller's website. The T&Cs are binding if the consumer checks the box provided for this purpose, acknowledging that they were known and accepted prior to placing the order. Confirmation of the validity of the order by confirmation constitutes the buyer's acceptance of the T&Cs in effect on the day the order was placed.
3. MODIFICATIONS TO THE GTC
The Seller reserves the right to modify its general terms and conditions at any time. In the event of modified GTC, the applicable GTC are the GTC in force on the date of the order, a dated copy of which may be provided to the consumer upon request.
4. PRODUCTS
Products are sold and delivered within the limits of available stocks. If the ordered product is out of stock, the seller will immediately inform the buyer and may provide the product of the same quality and price. Otherwise, a voucher for the same amount as the order may be provided, which can be used for the next order. If the buyer does not agree, the seller will refund the amount paid within 14 days.
5. PRICE
5.1.Sale price
For each product listed on the site, the sale price is expressed in euros, all French taxes included (French VAT and other potentially applicable taxes), excluding shipping costs, participation in order processing costs and packaging costs. The total amount due by the customer is displayed on the order confirmation page. The sale price of the product is the price in effect on the date of the order. The sale price of the products does not include shipping costs charged in addition to the price. In the event of price promotions, according to the conditions of application of the price promotions, the seller undertakes to apply the promotional price to any order placed during the promotional announcement period.
5.2.Modification
The Seller reserves the right to modify its prices at any time, while guaranteeing the consumer the application of the price in effect on the day of the order.
5.3. Fees
Shipping costs, participation in order processing costs and packaging costs will be indicated in the Customer's basket, before final validation of the order.
6. OFFER
The online sales offers on this site are intended for consumers worldwide. The online sales offers on the site are valid as long as the product appears on the site and while stocks last, with no specific duration indicated. Acceptance of the offer by the consumer is confirmed by validating the order using the double-click process.
If you have benefited from an offer and would like a refund, this will be made in proportion to the amount of the order.
7. ORDER
To place an order, the consumer, after filling their virtual basket by indicating the selected product and the desired quantity, then clicks on the "Order" button and enters the delivery and payment details.
Before clicking on the "Confirm order" button, the consumer can check the details of his order and its total price, and can return to the previous pages to correct any errors or possibly modify his order.
Confirmation of the order constitutes acceptance of the General Terms and Conditions and formation of the contract. The seller will send an email confirming receipt of the order and payment as soon as possible.
Once the order is placed on our online store, it is confirmed and sent to our warehouse. It is therefore no longer possible to modify or cancel it. You will receive an email as soon as it is shipped. The Seller reserves the right to refuse any order for legitimate reasons, particularly if the quantity of products ordered is abnormally high for the buyer as a consumer, even if the order is already being prepared.
The sales contract is formed when the consumer sends an order confirmation.
8. PAYMENT
Payment can be made immediately upon ordering.
The site is equipped with an online payment security system allowing the consumer to encrypt the transmission of their banking data.
8.1. Immediate payment upon ordering
The price is due in full after confirmation of the order.
Payment is made immediately upon ordering by credit card or via the Paypal system.
9. DELIVERY
Yade delivers its products to all countries around the world.
The Customer must ensure that they have provided accurate and complete information regarding the delivery address (such as, in particular: street number, building number, staircase number, access codes, names and/or intercom numbers, etc.). The products will be delivered to the address indicated by the customer on the order form.
Please refer to the "Delivery" tab located at the bottom of the website's homepage for delivery times.
If the product does not correspond to the order, the consumer must submit a complaint to the seller for a replacement of the product or possible cancellation of the sale.
If the delivered product is not available, the seller may offer a product of equivalent quality and price or a voucher.
10. LEGAL GUARANTEE OF CONFORMITY AND GUARANTEE AGAINST HIDDEN DEFECTS
All products supplied by the Seller are subject to the legal guarantee provided for by articles L221-1 et seq. of the Consumer Code and to the guarantee of hidden defects provided for by articles 1641 et seq. of the Civil Code.
The consumer has two (2) years to assert one or other of these guarantees.
For lack of conformity, the period runs from delivery of the product.
For hidden defects, the time limit runs from the discovery of the defect.
If the apparent defect, lack of conformity or even the hidden defect of the article, declared by the customer, where applicable, is proven, after expert appraisal, Yade undertakes to replace the product or to compensate the customer in the form of a purchase voucher within fourteen (14) days.
Yade cannot be held responsible for any misuse of the items by the customer.
11. CLAIMS
Claims made under the guarantees must be sent by email to contact@yade-paris.fr.
12. RESPONSIBILITIES
The Seller cannot be held liable in the event of non-performance or poor performance of the contract due either to the actions of the buyer, or to the insurmountable and unforeseeable actions of a third party to the contract, or to force majeure.
13. RETURNS AND REFUNDS OF PRODUCT(S)
13.1. Right of withdrawal
Within 14 days of receiving the order, the Customer may request the return of the Product(s) from Yade. The returned product(s) must be in new condition, not having been worn, tried on, used or otherwise used, and in their original packaging.
In case of return from France or the Belgium :
- Exchanges and credits are free 🎁
- For refunds, an amount of €4.50 will be deducted (€5.50 for Belgium) from the total amount refunded, and the return shipping costs are your responsibility.
- Only the first exchange is free. If the exchange item is returned, it is only possible to request a credit note or a refund, and the return shipping costs (€4.50 for France and €5.50 for Belgium) will be deducted from the refund.
In case of return from any other country :
- Only refunds and credits are offered. Return shipping costs are the customer's responsibility. The customer has the option to choose the carrier of their choice.
- Any customs fees associated with the return are also the responsibility of the customer.
For all returns, the associated risks are the responsibility of the customer. It is therefore recommended that they provide proof of return postage.
Upon receipt, and subject to these return conditions, the seller will exchange or refund the order excluding initial shipping costs by crediting the customer's bank account within 14 days of the seller receiving the package. If these return conditions are not respected, the amount necessary to repackage the item and put it back on sale will be deducted from the refunded amount.
13.2. Returns
Any request for exchange or refund of items must be made from this portal .
Return conditions
Items must be returned to us in their original condition, unworn and unwashed, in their original packaging intact, and with the product label undetached.
For the return of menstrual panties, the packaging must be intact, the tab above the zipper must not be torn. For the return of tights, the packaging must not have been opened.
If a part returns to us and does not meet these return conditions, the customer will be reimbursed with a deduction based on the anomaly noted, allowing the product to be repackaged in its original condition.
14. INTELLECTUAL PROPERTY
Under no circumstances is the Customer authorized to download or modify all or part of the Site and in particular its content (listed products, descriptions, images, videos, etc.).
This Site or any portion of this Site may not be reproduced, copied, sold or exploited for any commercial purpose without the express written permission of Yade.
Generally speaking, all copyrights, trademarks and other distinctive signs and property or intellectual property rights appearing on the Site will remain the full and entire property of Yade.
The Customer is therefore required to respect intellectual property rights and may not use the trademarks appearing on the Site and on the Products where applicable, or register a trademark which would be prejudicial to the rights holder, unless otherwise provided in the contract.
The same applies to any other intellectual property right.
15. PROTECTION OF PERSONAL DATA
Yade undertakes to use Customers' confidential information only for the purpose of operating its Site and ensuring the smooth running of orders and customer service.
For the smooth processing of the order, the personal data collected will be subject to computer processing, the Customer acknowledges having knowledge of this. As such, the information concerning him may be communicated to Yade's technical service providers.
Furthermore, Yade may use technical means to obtain non-personal information relating to Internet users and intended to improve the functionality of the site, for example by tracking the number of visitors to certain pages.
In accordance with the law of January 6, 1978, amended by the law of August 6, 2004, the Client has the right to access and rectify their personal data contained in Yade's files. All requests should be sent by email to: contact@yade-paris.fr.
16. APPLICABLE LAW, LANGUAGE AND DISPUTES
These General Terms and Conditions and accepted orders are subject to French law. The language of these General Terms and Conditions and accepted orders is French. In the event of a dispute, the French courts shall have sole jurisdiction.
